This lecture was delivered at the National World War I Museum and Memorial's Symposium -- 1916 | Total War -- which was held in Kansas City, Mo. November 4-5, 2016. For more information about the National WWI Museum and Memorial visit http://theworldwar.org This talk looks at the war at sea during the Great War during perhaps its pivotal year, 1916. It will discuss the dynamics of the Allied blockade, the ongoing escalation of German actions leading to the Battle of Jutland, and the decision by the Germans to turn again to unrestricted submarine warfare as a means to end the war in late 1916. These actions occurred against the backdrop of horrific campaigns on land—and the mounting sense of frustration by naval officers with the war they had, not the one they wanted. John T. Kuehn, Ph.D. is currently Professor of Military History at the US Army Command and General Staff College and has served on the faculty there since July 2000, retiring from the Navy 2004. He earned a Ph.D. in History from Kansas State University in 2007. He is the author of Agents of Innovation (2008) and co-authored Eyewitness Pacific Theater (2008) with D.M. Giangreco, A Military History of Japan (2014) as well as numerous articles and editorials. He was awarded a Moncado Prize from the Society for Military History in 2010. His latest book is Napoleonic Warfare: The Operational Art of the Great Campaigns.(2015) His next book, entitled America’s First General Staff about the General Board of the US Navy will be published by Naval Institute Press next year.

Records # 5820) broke into the Billboard singles chart on 4 June 1966, bubbling under the Hot 100 at # 133. After four weeks, on 2 July 1966, the single peaked at # 35 in the Billboard Hot 100. In the same edition, Billboard printed a letter from a record company owner, praising the single, saying: "we believe the recoding industry owes a vote of thanks to Warner Bros. Records for its latest hit 'Day of Decision'. Of late there has been a tendency to consider patriotism corny, to call expressing love for the USA as square. We Americans have good reason to be proud of our heritage, and should not hide the pride we feel for our country....We applaud Johnny Sea for a superb rendition". It reached # 28 in the Billboard Country Chart on 2 July 1966. On 9 July 1966, it rose to # 20 in the Country chart. The album "Day for Decision" (Warner Bros. Records # W-1659) received a Grammy Nomination for Best Spoken Word, Documentary Or Drama Recording, losing out to Everett McKinley Dirksen (for his patriotic "Gallant Men"). Johnny Sea (born John Allan Seay, Jr. in Gulfport, MS, 15 July 1940) narrated the song, composed by Allen Peltier, over a musical arrangement by Ernie Freeman. Produced by Gene Nash. The music included an oriental sound, intending to refer to Vietnam, and maybe China as well. It concluded with a choir singing "America the Beautiful". The song started out with the menacing, prophetic views of McGuire, declaring that "American is in real trouble" and that they were in the "age of the American cynic, the year of the unbeliever, the day of doubt". The narrator believed that problems were not in the "rice paddies of Vietnam", China, or other "win-less conflicts", but in the United States. And the problem in the US? The narrator criticised the lack of patriotism, claiming that people "stare at...shoelaces" when the national anthem played. He then went a step further, and suggested that the "newsreels of the discontented marching" (i.e. the anti-war movement) provided support to the "Viet Cong in the swampy jungles of Vietnam". Moreover, the "better red than dead cancer" spreading in the US (i.e. those who would rather live under communism than fight and die in a war), caused fear amongst the GIs in Vietnam (as opposed to "better dead than red") - these were competing Cold War slogans in the US and UK since the 1950s, often attributed to Bertrand Russel and the UK Nuclear Disarmament Movement. The lyrics also commented on the US political system - it said that the structure and ideals of the US government had not changed, but that the people had, and that this change threatened a "fragile" democracy. He also believed that public office had been corrupted by money.

Arbitration Decision on South China Sea Illegal, Invalid: Chinese Scholars

The South China Sea arbitration filed unilaterally by the government of Benigno Aquino the Third is illegal and invalid, according to Chinese scholar Gong Yingchun. The 15 arbitration appeals of the Philippines can be divided into three categories - doubts about the nine-dashed line, questions about China's sovereignty over several islands, and the claims of China on its rights and interests in the South China Sea damaging the Philippines' interest. For Gong, an associate professor of international law from China Foreign Affairs University, the Aquino administration hid his real intention with the arbitration. The case is in essence one of territorial sovereignty. "Firstly, he (Benigno S. Aquino III) focused on the so-called nine land features that China is controlling, though as a matter of fact, not all of them are controlled by China. But for those that are illegally occupied by the Philippines, he never mentions them, as if they are not an issue. In essence, he denies China's sovereignty over the islands, reefs and low-tide elevations," said Gong. The Arbitral Tribunal has no rights to rule on boundary delimitation, according to Article 298 of the United Nations Convention on the Law of the Sea (UNCLOS), Gong said. Meanwhile, China declared for optional exceptions in accordance with Article 298 of UNCLOS of not accepting third-party compulsory settlement procedure. So China's refusal to participate in the arbitration and accept its decision complies with the international law. "So far, all the five permanent members of the security council except for the United States, which is not a UNCLOS member, have made similar declarations for optional exceptions in accordance with Article 298. And this shows the stance and understanding of major countries of the international community as regards disputes settlement. All are cautious about third-party compulsory settlement procedures," said Gong. Gong also questioned the legitimacy of the Arbitral Tribunal, as the temporary court consists of just five people, and its presiding judge Shunji Yanai, who proposed to Abe to lift the ban on collective self-defense right, appointed four of them. "From the very beginning of this case, from the appointment of its presiding judge to the formation of the court members, manipulation comes easily. Rules are especially made for this case, different from the rules of the International Tribunal for the Law of the Sea and other courts that are set. So they are willful to a great extent and little restrained. But the case it handles is far from simple, like the case of the territory delimitation it has handed over this time to five people," said Gong. Gong said that the implementation of the arbitration procedure by the Tribunal is also a violation of and damage to UNCLOS, as it's an act beyond its authority. "Part XV of UNCLOS on disputes settlement is an integral part. The severed application of this mechanism will damage not only China, as now many countries have expressed their worries that such application will ultimately damage the authority, legitimacy and integrity of the Convention's dispute settlement mechanism," said Gong. China has signed the Declaration on the Code of Conduct (DOC) on the South China Sea with ten countries of the Association of Southeast Asian Nations (AESAN), including the Philippines, to better solve their disputes on the South China Sea. All sides have made their commitments as how to solve disputes on the South China Sea issue, according to Hou Yi, deputy director of sea boundary office under the Institute of Chinese Borderland Studies. "Article 4 of DOC explicitly states that disputes on the South China Sea should be solved through negotiations, but the Philippines does not follow it. Instead, it chose international arbitration. Its goal is to force pressure on China through a third party to protect their illegal gains and interest. Its intention is very obvious," said Hou. The Benigno Aquino III government's unilateral request for arbitration on the South China Sea is an act of bad faith, and has no political and legal ground, said Gong. "Politically, it is about good faith, which is a foundation of international relations. If intergovernmental agreements of such a high level can be breached and abandoned willfully like this, the foundation of international relations will be endangered. Legally, there is a saying about estoppel, that is, you cannot go back on your word," said Gong. First Sea Lord, Admiral Sir Jonathon Band, has welcomed the announcement made yesterday, Wednesday 25 July 2007, that the Royal Navy are to receive two new 65,000 tonne aircraft carriers. The decision, announced by Defence Secretary Des Browne in Parliament , will see two new ships in service by 2014 and 2016 respectively. The aircraft carriers will be named HMS Queen Elizabeth and HMS Prince of Wales. Admiral Band said: "This confirms the Government's intended policy to maintain the Royal Navy as a global force with the ability to take air power anywhere around the world."

In the letter dated Aug 25, seen by Channel NewsAsia, China said Indonesia’s move to change an “internationally accepted name” results in the “complication and expansion of the dispute, and affects peace and stability”.“The ChinaIndonesian relationship is developing in a healthy and stable way, and the South China Sea dispute is progressing well,” the Chinese Foreign Ministry said. “Indonesia’s unilateral namechanging actions are not conducive to maintaining this excellent situation.”Beijing also said China and Indonesia have overlapping maritime claims in the southwest of the South China Sea, and said that renaming the area will not change this fact. Indonesia has never made any claim to parts of the South China Sea, disputed with China by Philippines, Brunei, Malaysia, Taiwan and Vietnam. But the waters it now calls the North Natuna Sea overlap with China’s unilaterally declared NineDash Line, which takes in virtually all the South China Sea. Indonesia’s move comes after the 2016 findings of the Permanent Court of Arbitration at the Hague in the Netherlands on the South China Sea dispute between China and the Philippines, which concluded that there is no legal or historical basis to China’s claim to the resourcerich waters. In July, Indonesian Coordinating Minister for Maritime Affairs Luhut Pandjaitan denied that Indonesia is renaming the South China Sea, as the northern waters off Indonesia’s Natuna archipelago are part of the country’s exclusive economic zone. ----------------------------------------------------------------------------------------------------

(23 Mar 2018) Bolivian President Evo Morales led the annual Sea Day procession in La Paz on Friday, marking 139 years since his country lost the War of the Pacific, and its entire coastline, to neighbouring Chile. During the five year conflict which began in 1879, the joint forces of Bolivia and Peru fought Chile, but lost with Chile claiming Bolivia's Pacific shoreline. Morales took a more conciliatory tone than in years past, saying "I offer my hand in fraternity" so that together Chile and Bolivia "work arm in arm for a lasting peace." Earlier this month Bolivia made an emotional appeal at the International Court of Justice asking that it order Chile to enter talks over granting the landlocked South American nation access to the Pacific Ocean, saying the dispute will remain a source of conflict if it's not resolved. The Chilean government says there is no outstanding territorial issues on the coastline, given the two counties signed a treaty after the war in 1904. Chile has given Bolivia special rights to a port in the area, but has refused to grant it territory. Ji Myung-kil provides a closer look at the first ruling on the cluster of overlapping claims in the disputed region by an international court, as well as China's anger-charged response. The Permanent Court of Arbitration based in the Hague ruled in favor of the Philippines and concluded that China has no legal basis to claim historic rights to resources within the South China Sea. The Philippines welcomed the landmark decision. "The Philippines strongly affirms its respect for this milestone decision as an important contribution to ongoing efforts in addressing ongoing efforts in addressing disputes in the South China Sea." China published a map in 1947 which outlined its claims to the South China Sea -- the basis of its so-called "nine-dash line" -- stretching 3-point-5 million square kilometers from China's southern coast. The arbitration court said China had interfered with traditional Philippine fishing rights at Scarborough Shoal and breached the Philippines' sovereign rights by exploring for oil and gas near the Reed Bank. But China refuses to acknowledge the tribunal's ruling. "I should say the so-called arbitral tribunal was based on the illegal action and claim of the Philippines from the very onset. So its very existence is not legitimate." Manila asked the court to mediate on the rights it has to the disputed waters under the United Nations Convention on Law of the Sea in 2013. Experts said the ruling will have deep implications. "This is an absolutely huge decision, it doesn't come as a complete surprise but to have the international court rule on the illegitimacy of the Nine-dotted line is a huge development." Although the international tribunal ruled in favor of the Philippines, the court has no mechanism to enforce the decision, be it through military action or economic sanctions. But analysts predict the ruling could prompt other neighboring countries like Taiwan, Malaysia, Vietnam and Brunei to file similar claims,... putting increased diplomatic pressure on Beijing to reduce its presence in the South China Sea. However, it turned a blind eye to the fact that the Philippines’ submissions concern the territorial and maritime delimitation dispute between China and the Philippines, disregarded the agreement that exists between the two States on settling relevant disputes through negotiation, and acted ultra vires by exercising its jurisdiction over and deciding upon the submissions. This is the most fundamental error committed by the Tribunal in this Arbitration” (p. 649). The CSIL (2018) next proceeds to argue that the PCA tribunal had “erred in fact finding, and law interpretation and application.” Among these errors are those pertaining to China’s historic claims: “The Tribunal misread the relationship between the Convention and historic rights, resorted to selective and arbitrary use of materials, erroneously characterized China’s historic rights, and erroneously decided that China did not enjoy such historic rights in the South China Sea.” The CSIL also argues that the PCA tribunal had made factual errors with regard to the physical and human geography of the features in the disputed maritime area. The US Navy is planning to finalize weapons integration on its new USS Ford carrier and explode bombs in various sea conditions near the ship to prepare for major combat on the open seas, service officials said. Service weapons testers will detonate a wide range of bombs, to include a variety of underwater sea mines to assess the carrier’s ability to withstand enemy attacks. “Shock Trials,” as they are called, are typically one of the final stages in the Navy process designed to bring warships from development to operational deployment. The USS Gerald R. Ford will conduct further trails and testing, culminating in full-ship shock trials.
