Have you ever wondered how products get their names? Swiffer, BlackBerry, Febreze, Dibs, Dasani– all these brands have one thing in common. They are products named by a small firm in Sausalito, California, called Lexicon Branding. The firm, founded by David Placek, has invested heavily in an area of linguistics called “sound symbolism,” which tracks the associations evoked by specific letters, across languages and cultures. They found that ‘v’ conjured energy and aliveness– think Corvette and Viagra– while ‘b’ and ‘t’ recalled reliability– as with BlackRock; T-Mobile; and BlackBerry, which Lexicon named. It can be difficult to settle on phrasing that is able to convert a chosen message across a broad spectrum of cultural and language barriers without something getting lost or redefined along the way. Just ask Apple Inc., which learned the hard way that SIRI, iPhone’s personal assistant software, translates to mean a rather vulgar word for penis in the Georgian language. So it’s hard to blame these foreign companies for losing something in translation upon releasing products with names that are, admittedly, pretty amusing to English-speaking consumers. That is, in the event that these actually are mistakes. While some of the items listed here are clearly innocent translation errors, some do seem to be deliberate, tongue-in-cheek attempts to be provocative and to draw a few more eyeballs with some curiously worded packaging. Indeed, in an era where any online blog can generate millions of views from across the world, a silly product from Ghana can become a worldwide phenomenon immediately. While these translation faux pas can be highly amusing for consumers and other on-lookers, they can represent awfully expensive mistakes for the corporations unfortunate enough to make them. Sometimes, a company will lose money on a dud of an ad campaign over a cultural mis-step, as was the case when Pampers flopped in Japan after including a stork delivering babies on its packaging and thereby confusing Japanese customers who weren’t familiar with that culture-specific folklore. Other times, a poorly researched marketing campaign launch can wind up retracted at a significant expense over a translation snafu, such as when HSBC Bank’s “Assume Nothing” tagline translated to “Do Nothing” in many countries, prompting a $10 million brand overhaul overseas. We in North America are hardly perfect when it comes to branding messages that don’t quite hit the target overseas. On top of the iPhone and HSBC Bank fiascoes, KFC initially ran into trouble in China when it’s “Finger-lickin’ good” tagline translated to the less appealing “Eat your fingers off”. Surely other countries could build their own lists of product launches stemming from the US that went comically awry when they crossed the ocean. For the purposes of this list, however, we focused in on products that, whether knowingly or unknowingly, carry a certain – and undeniably entertaining - charge when translated to English. Whether these are unintentionally hilarious miscues or deliberate, devilish winks from marketers who know they will draw some added attention, it’s hard to believe that any of these raunchily-titled products will have English-speaking consumers flocking to the grocery store or the web to buy them. Unless, of course, sucking down a “Vergina beer” is your sort of thing. But hey, they will certainly get you aware and talking. And isn’t that just the point of brand marketing? When Should I Trademark My Name or Logo? - All Up In Yo' Business

Contact Aiden and learn more at www.180lawco.com. Someone asked me recently when is the best time to trademark your business name or logo. The simple answer: As soon as possible! Really, in general, the sooner the better for filing a trademark for your business name or logo. I discussed in a previous video that you have some trademark rights under common law even if you never register it with the U.S. Patent and Trademark Office (USPTO). But, having a registered trademark is infinitely better and it makes your trademark rights a lot stronger. So, even though you might have a common law trademark in something, its always better to actually register the trademark if you can. To register a trademark, you do have to be actively using whatever the trademark is in commerce. So, if your business is already established, i.e., you have a website or marketing materials using your business name or logo that you are trying to trademark, then you are actively using it in commerce and that will work in your favor when you try to get it registered. If you’re not quite there yet, for example, maybe all you have so far is a great logo, you can still file an application for the trademark. However it is an “intent to use” application… and it is exactly what it sounds like. It means that you are intending to use whatever the trademark is. So, that will buy you some time in being able to actively use that trademark in commerce, but still getting that protection if your trademark is ultimately registered. So, even if your business is not actively started yet, you can, in most cases, still file that intent to use application to get a head start on that trademark registration. So, simply put, the sooner you can file a trademark application, the better off you are. It basically gets you first in line in priority of using that trademark, assuming no one else has already used it. And if you are still getting your business started, you can file that intent to use application in order to get a little extra time for you to start using it actively in commerce. They were able to do all of this: WITHOUT paid ads WITHOUT creating a product WITHOUT dealing with customer service WITHOUT a website or email list To do this, they use a simple 3-step system called “Reverse Wholesale”. Here’s how it works: STEP 1: LOCATE HIGH-PROFIT, HIGH POTENTIAL BRANDED PRODUCTS ON AMAZON This step involves looking for branded products on Amazon that have a HUGE buyer demand, but very bad listings. In essence, your aim is to “refurbish” a product that is ALREADY proven to sell well. By refurbish, we mean improving its images, product title, product description and also features and benefits. When a product that everyone is buying has a poor listing, you now have the opportunity to improve this listing - and make even MORE sales. STEP 2: CREATE A WHOLESALE ACCOUNT The next step is to ask to open a Wholesale Account with the manufacturer of the product you have identified. You do this to gain access to their Wholesale distributor so that you can buy the product at discounted rates and sell them for a profit. However, there is a slight catch: Manufacturers don’t just accept anybody. That’s why you use Dan’s secret method. Instead of trying to lie your way through to opening an account, you take a different approach. You NEGOTIATE. You say, “Hey, I’ll come in, edit your listing and MASSIVELY increase your sales. In exchange, we’ll make a contract, we’ll make a deal. My business, my company, gets the right to buy these products direct from your manufacturer, at wholesale, discounted rates. I will then send these items into Amazon for you, and I will “manage” your listing and grow your sales.” This is a deal that’s hard to turn down. At the end of the day, it is a win-win situation. For you: You get DIRECT access to the manufacturers instead of having to go through the distributor. This means that you can buy items from them in bulk at a MASSIVE discount, allowing you to make more profits on the items you sell! For them: More money! Considering this is a long-term deal, you’re going to make them A LOT more money since you’ll be regularly buying their items in bulk. (Who wouldn’t want that?!) STEP 3: OPTIMIZE THE LISTING, PURCHASE THE PRODUCTS AND MAKE MONEY! The final step involves editing their listing to make it even better. Adding better photos. Adding a great title. Adding a great description - and greatly increasing the conversions and sales. You then buy the product you want to sell at wholesale, discounted rates, then ship them into one of Amazon’s FBA warehouses. Amazon’s FBA warehouses are incredible. They store these items for you. When a customer purchases your item, Amazon will pick, pack and ship this item off to your customer - without you having to even lift a finger. This means you don’t have to do ANY of the heavy lifting. At this point it’s basically a passive source of income. All you have to do is order new products when inventory gets low. It’s upfront work for long-term rewards!

Make sure it is not the first photo or the last two photos. Second Level: - Have your logo printed on a sticker that you attach to your product or to the packaging. - Have your logo printed on the product or the retail packaging of your product Third Level: - Accessorizing. Add accessories to your core product that no one else is adding to theirs. Once you made sure that there are no conflicting earlier trademarks or company names, then you can actually file your trademark application with the intellectual property office of your country or region. Many trademark offices nowadays offer to file trademarks using a simple web form. You can navigate there and then enter the information that we compiled above. Once submitted, you can a receipt and the office will then start examining your trademark application. The trademark gets registered, if the office did not find any formal errors or did not object to the trademark application for other reasons such as descriptiveness of the mark. Once your trademark is registered, you can use the trademark e.g. to tell other competitors not to use identical or very similar names for the protected services. Or you can issue licenses to your trademark for other dance studio owners and make money that way. I hope I was able to show you how to protect a name or business name. Customers and employees can build up emotional attachments to certain brands, allowing for strong loyalties and even a sense of ownership. This can help maintain employee motivation and increase your sales but it can also cause problems if you don't consult these stakeholders as your business grows. Your brand is what you are really selling to your customers, not just a product or service for which there may already be many existing providers.
